Egtved — Maintenance for Sealed Gas High Speed Motor-compressors with Magnetic Bearings
The service agreement comprise ongoing maintenance, repair and service for electric-driven MOPICO compressors with associated equipment at the Egtved Gaskompressor-station, including regular service inspections, call-out service, replacement of spareparts, remote monitoring and ad-hoc advise.

The service agreement comprise ongoing maintenance, repair and service for electric-driven MOPICO compressors manufactured by MAN with associated equipment at the Egtved Gaskompressorstation, including regular service inspections, call-out service, replacement of spare parts, remote monitoring and ad-hoc advise. The duration of the service agreement – which Energinets intends to enter into with the current supplier MAN Energy Solutions– is (up to) 5 years. The anticipated spend I EUR 500 000 per year based on past figures.
Section IV: Procedure
- The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons
In accordance with Art. 50 of the EU Utilities Directive (Directive 2014/25/EU of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport and postal services sectors and repealing Directive 2004/17/EC), Energinet intends to enter into a new service agreement with the existing supplier man energy solutions, as a change of supplier is impossible or would result in disproportionate technical difficulties in operation and maintenance for the following reasons:
— the compressors, to which the services relate, are manufactured by MAN. The service requires OEM spare parts, which no other supplier than MAN is able to deliver;
— only the manufacturer of the compressors (MAN) has access to applicable drawings and documentation;
— encapsulated ATEX equipment should only be serviced by the manufacturer (MAN) for safety reasons;
— only the manufacturer of the compressors (MAN) is able to program, update and alter the existing software in the equipment comprised by the service agreement;
— due to the redevelopment of the TYRA gas field the operation of the Egtved Gas compressor station is of critical importance for the Danish gas infrastructure and hence, downtime must be avoided.

Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the contracting authority has sent notification to the candidates involved, provided that the notification includes a short account of the relevant reasons for the decision.
Other complaints must be filed with The Complaints Board for Public Procurement within:
1) 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union (with effect from the day following the publication date);
2) 30 calendar days starting the day after the contracting authority has informed the tenderers in question, that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes a short account of the relevant reasons for the decision;
3) 6 months starting the day after the contracting authority has sent notification to the candidates/tenderers involved that the contracting authority has entered into the framework agreement, provided that the notification included a short account of the relevant reasons for the decision;
4) 30 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union which clarifies the reasons for the contract being awarded without prior publication of a contract notice (when the procedure described in section 4 of the Act on the Danish Complaints Board for Public Procurement (kla-genævnsloven) has been followed).
Energinet shall follow the procedure in Section 4 of the Act on the Board of Appeal (Consolidated Act No 593 of 2 June 2016 on the Public Procurement Board of Appeal, available at: www.retsinformation.dk). Thus, the intended contract will not be concluded before the expiry of 10 calendar days with effect from the day following the date of publication of this notice, cf. Section 4 (1) (2) of the Act on the Board of Appeal.
