Due to the below DanPilot has decided to cancel this procurement procedure:
— It has come to DanPilot's attention, that the minimum requirement to the candidates' economic and financial standing is not sufficiently transparent to meet the principle regarding transparency in public procurements, and thus unsuitable for assessment in accordance with the principle of equal treatment. Completion of the prequalification based on the current material would therefore be contrary to the principles regarding transparency and equal treatment.
— DanPilot has found that a number of the above mentioned candidates have given very brief and to some extent unconcrete replies to the requested information. Completion of the assessment on the basis of the received replies would require an estimate to an extent, that may be in conflict with the principle of equal treatment.
When a revised material has been drafted, it is DanPilot's intention to publish a new procurement within very short time.

Section II: Object
Acquisition of ‘New Pilot Boats’ for DanPilot.
This procurement material applies to DanPilot's invitation to the competitive procedure with negotiation regarding acquisition of up to fifteen (15) ‘New Pilot Boats’.
DanPilot is an independent public enterprise under the Ministry of Business and Growth, with the Danish Maritime Authority as the supervising authority. DanPilot handles the public pilotage through Danish territorial waters from any destination in Denmark to all ports in Denmark and in the Baltic Sea all year round and any time of day.
The tenderer shall be able to deliver fifteen (15) of the offered pilot boat. DanPilot is committed to buy eleven (11) of the offered pilot boat. The remaining four (4) pilot boats is optional for DanPilot.
The operation of the offered pilot boats is intended for safe boat-to-ship transfer of pilots at medium speed, and for transit from port-to-ship and reverse at high speed, in the coastal water, sounds and fjords around Denmark. Further, the offered pilot boats will occasionally be operated in light sea ice as it appears in Danish waters.
It is the intention of DanPilot to acquire new build pilot boats ready and approved by the Danish Maritime Authorities (DMA) for operation as a Pilot Boat fulfilling all applicable rules and regulations as set by DMA.
The Procurement material and the appendices describe the details of the procurement procedure and the contract. For more information regarding the technical specifications, see Contract Appendix A — Tender Requirement Specification. For more information regarding contract terms, se Appendix 4 and Appendix 4.1.
Among the candidates who are suitable based on the requested information in the Procurement material section B.4, DanPilot will prequalify minimum five (5) and maximum seven (7) candidates. If less than five (5) suitable requests are received, DanPilot will prequalify the number of candidates who are suitable. These candidates will be invited to submit a tender.
The choice of candidates will be based on an overall assessment of the requested information and documentation in the Procurement material section B.4.1(c). The listed references comparability to the boat put out for tender will be off high importance in the assessment.
DanPilot will take the following into consideration when choosing the candidates' based on the information in the Procurment material section B.4.1(c):
— References:
— The type of commercial workboats delivered in the references described, where delivery of pilot boats will be weighted positively
— Number of commercial workboats, as defined in section B.4.1(c), delivered in each of the references described, where a high number of commercial workboats in each of the references will be weighted positively
— The candidates' production facilities:
— Good production and working environment in enclosed buildings fulfilling requirements for production of and working with materials, equipment and modern production technology used by the candidate
— Logic storage and production flow line in separated areas with a minimum of handling and processing (e.g. hull production, assembly, outfitting, workshops etc.)
— Capacity for serial production
— The candidates' quality assessment procedure:
— A quality management system on par with ISO 9001 or other quality management system with similar objectives
— Well defined and exercised quality control and assurance procedures and processes
— Good and modern test facilities fulfilling production and certification requirements, e.g. by dedicated personnel with adequate competencies and utilizing recognized technology, procedures and equipment.
DanPilot is committed to buy eleven (11) of the offered pilot boat. The remaining four (4) pilot boats is optional for DanPilot.
DanPilot have until delivery of the 11th pilot boat to decide whether or not they will exercise the option and buy more than eleven (11), but maximum fifteen (15), of the offered pilot boat. The pilot boats included in the option shall be delivered no later than two (2) years from the delivery of the 11th pilot boat. DanPilot and the tenderer will agree on a detailed delivery plan.

A. Personal situation of the candidate

o Conflict of interest due to its participation in the procurement procedure
o Direct or indirect involvement in the preparation of this procurement procedure
o Guilty of misinterpretation, withheld information, unable to provide required documents and obtained confidential information of this procedure.
Description of the candidates D&B rating (Dun & Bradstreet rating), which shows the candidates credit-worthiness. To be rated the candidate shall contact Dun & Bradstreet.

The D&B rating stated in the request for prequalification cannot be older than three (3) months from the deadline for submission of request for prequalification.
DanPilot will refund any expenses connected to the candidate being rated by Dun & Bradstreet, provided these expenses are documented by an invoice or similar from Dun & Bradstreet. Documentation for expenses can be forwarded with the request for prequalification including the bank account number to which the expenses can be refunded.
Please state the D&B rating in the ESPD part IV. B in the field ‘Other economic or financial requirements’.
It is a minimum requirement that the candidate is rated with 1A3 on the D&B rating, meaning minimum 1A in Financial Strength and minimum 3 on the Risk Indicator.
A. References:
Description of up to five (5) of the candidates' principal references regarding contracts from comparable deliveries.
Comparable deliveries in this sense are defined as Commercial Workboats comparable to the boat put out for tender regarding size, speed and capacity that has been designed and/or built and put into operation within the last 10 years, and operated successfully for minimum 6 months within the last 5 years.
Commercial Workboats in this sense are defined as a pilot boat, a crew boat, a SAR boat, a patrol boat or other similar workboat that has been built for purpose and certified for commercial use according to rules and regulation by Class, and/or by European Flag State.
References should state:
— client as well as contact person and the telephone number of the contact person,
— a short description of the contract and the delivered boat(s), including type, size, speed and capacity and
— information about date of delivery, time period for production and delivery, number of boats delivered, time and place in operation and the sum of the contract
Please notice: If the candidate describes more than five (5) references, only the five (5) newest will be assessed. If the references lack one or more of the above mentioned information this may have a negative effect on the assessment of the candidate.

B. The candidates' quality assessment procedure:
Description and/or illustration of the candidates' quality management and assurance procedure and organization securing the quality of the products and deliveries. The candidate can describe relevant ISO-certifications or quality management and assurance procedures with similar objectives, obtained by the candidate, that includes measurement, analysis and improvement processes.
Please state the reply in the ESPD part IV. C in the field ‘Technical facilities and measures for ensuring quality’.
C. The candidates' production facilities:
Description of the candidates' production facilities and test facilities, which show to what extent the facilities are suitable for the purpose, which among others means serial production and subsequent delivery of commercial work boats, as defined above, in numbers comparable to this acquisition. The candidate shall describe and/or illustrate their production facilities i.e. design office, workshops, storage areas, test facilities. Furthermore, the candidate shall describe and/or illustrate how these productions facilities will be utilized by the candidate for the delivery i.e. including a description of handling and storing of material and equipment, production areas environment, general production methodology etc.

Questions regarding the prequalification:
Candidates are requested to seek clarification and answers to any queries by asking questions regarding the prequalification.
All enquiries and questions regarding the prequalification should be made in writing and sent by e-mail to kontakt@tohv.dk with the following subject line: ‘Questions — Prequalification, New Pilot Boats’ no later than 14.9.2016, 12:00 CET.

Due to the nearby deadline for submission of request for prequalification, candidates are encouraged to keep themselves informed of the questions and answers on DanPilot's homepage.
Confirmation of content in ESPD:
The prequalified candidates shall on request from DanPilot and before the deadline for submission of Initial Offer provide documentation according to the Danish procurement law (Udbudsloven) § 152 regarding the information that the candidate has given in Appendix 1 — ESPD (European single procurement document).
A. Personal situation of the candidate: If the candidate is from Denmark, the documentation regarding the information given according to section B.4.1(a) shall be in form of an Official Certificate (Serviceattest) from the Danish Business Authority (Erhvervsstyrelsen). The Official Certificate shall contain information from the police (Det Centrale Kriminalregister) why the candidate shall complete and sign a declaration of consent (samtykkeerklæring) which shall be uploaded when the Official Certificate is ordered. The Official Certificate will not be accepted if it is older than six (6) months from the deadline for submission of request for prequalification.
Please note that the processing time at the Danish Business Authority is about 2 weeks from the day where they receive the order for the Official Certificate.
If the candidate is not from Denmark and if the homeland of the candidate doesn't issue the relevant certificates or documents, or if these certificates or documents doesn't cover all of the relevant circumstances they can be replaced by an affidavit. If the candidate's homeland doesn't use affidavits the candidate can use a solemn declaration.
B. Economic and financial standing: The documentation regarding the information given according to section B.4.1(b) shall be in form of a report from Dun & Bradstreet showing the D&B rating. The report will not be accepted if it is older than three (3) months from the deadline for submission of request for prequalification.

Complains about not being pre-qualified: Within 20 calendar days from notification of the result, if the notification contains a short explanation of the relevant reasons for the decision. Counting from the day after the day where the contracting authority has sent the notification to the involved candidates.
